Am I entitled to Sick Pay? (UK)?

Well, this is a long story…
I was off work, im a nurse with the NHS, from March 2007 to March 2008 on maternity leave. I was due to go back to work as normal however my baby son was diagnosed with a severe life limiting illness so my employer decided i’d be better taking a career break which I did from June 2008 to June 2009, My son went into hospital in June 2008 and sadly died in November 2008. As you can imagine my world has collapsed and I am distraught. I was told that I had to resume back to work in hospital in June 2009 or I’d lose my continued service. The thought of going back to work makes me ill, my son spent 5 months in hospital before he died, most of it in Intensive Care. I went to see Occupational Health and they advised me to go off sick, I got a sick line from my doctor and now Human Resources say that I can’t go off sick, Ive broken my service and I have to take another career break. What can I do? I need sick pay as im not earning at all and I was given the wrong advice re going from a career break onto sick.
Sorry this is so long, hope someone can help/advise.

  1. Sorry i cant offer you any definitive advise, but id like to say how sorry i am for your loss!
    Have you tried going to the CAB for advise?
